DEVELOPMENT OF DESIGN AND ESTIMATE DOCUMENTATION FOR THE CONSTRUCTION OF THE FACILITY “TAILINGS TRANSFER POND OF THE KUMTOR MINE MILL HISTORICAL TAILINGS PROCESSING COMPLEX”

Kumtor Gold Company CJSC invites to participate in the open selection for provision of the services:
Development of design and estimate documentation for the construction of the facility “Tailings Transfer Pond of the Kumtor Mine Mill Historical Tailings Processing Complex” according to the Terms of Reference. 

Submission format:

Proposals, including documents, appendices, and quotations, shall be signed by a person authorized to sign the commercial proposal and contractual obligations. Documents shall be sealed and submitted in PDF format. The authority of the signatory shall be confirmed by a power of attorney or certified copies of relevant documents.

Procedure for submitting proposals.

Selection Participants shall submit a Commercial Proposal in Russian and/or English in accordance with the Terms of Reference, attach the required copies of documents and send them in electronic format by e-mail to tailingsdump2025@kumtor.kg no later than January 24, 2025, 12:00 p.m.

Potential Selection Participants may officially request additional documents required to prepare a commercial proposal. Documents shall be provided based on a signed Confidentiality Agreement (the Agreement form is attached).

Commercial proposal shall contain the following documents:

• Commercial proposal on the official letterhead of the Participant addressed to Kumtor Gold Company CJSC, indicating the cost and terms of works, payment terms, stamped and signed by an authorized person.
• Estimate documentation/calculation (breakdown of costs) of services.
• Description of scope of services.
• Schedule of services.
• Company presentation.
• References for services in the design of tailings facilities of processing enterprises in the mining and processing area.
• Registration/statutory documents, licenses, certificates.

For residents of the Kyrgyz Republic:

Documents required:

1. Letter confirming interest in participation.
2. Detailed information about the company:

• necessary permits, licenses of design organization for construction engineering and design (not lower than 1-st level of responsibility) and qualification certificates, diplomas of specialists engaged to render services.
• reference list of at least 3 successfully implemented similar engineering projects for the last 10 years (copies of contracts for previously performed works).
• information on the availability of a resource base (designers in areas with at least 3 years of experience, economists and other specialists, office equipment, necessary software, etc.).
• recommendations, feedback.

3. Scanned copy of the certificate of registration of a legal entity.
4. Scanned copy of the document defining the main type of activity (Charter), as well as scanned copy of the resolution on appointment as a manager.
5. Scanned copies of the original financial statements for 2021–2022–2023:

• Accounting balance sheet.
• Profit and loss statement.
• Cash flow statement.
• Capital flow statement.
• Unified tax declaration.

6. Certificate of absence of arrears on tax payments and insurance contributions to state authorities as of the last reporting date.

For non-residents (participants from other countries):

Documents required:

1. Letter confirming interest in participation.
2. Detailed information about the company:

• necessary permits, licenses of design organization for construction engineering and design (not lower than 1^st level of responsibility) according to the legislation of the Kyrgyz Republic (if available, and if not, see item 6 below) and qualification certificates, diplomas of specialists engaged to render services.
• reference list of at least 3 successfully implemented similar engineering projects for the last 10 years (copies of contracts for previously performed works).
• information on the availability of a resource base (designers in areas with at least 3 years of experience, economists and other specialists, office equipment, necessary software, etc.).
• recommendations, feedback.

3. Scanned copies of registration and constituent documents of the procurement participant.
4. Scanned copies of the original financial statements.
5. Scanned copies of qualification documents.
6. Consortium agreement/simple partnership or other form of cooperation with a local design company having the appropriate KR license for construction engineering and design (not lower than 1^st level of responsibility) to bring the DED in line (adaptation) with the KR regulatory legal acts, regulatory technical documents in the field of architectural and construction activities.

• Proposal with the subject line: “Tailings Transfer Pond of the Kumtor Mine Mill Historical Tailings Processing Complex” shall be sent by e-mail to tailingsdump2025@kumtor.kg no later than January 24, 2025, 12:00 p.m.

The Customer shall have the right to accept or reject any or all proposals, as well as to cancel the open selection process at any time prior to the award of the Contract, without incurring any obligation to the relevant participants.

The cost of services specified by the Selection Participant shall include all expenses, including taxes, duties, fees, and other payments levied in accordance with the legislation of the Kyrgyz Republic, and other expenses for fulfilling contractual obligations, considering the period of services, related services specified in the Contract.

Evaluation criteria: the winning proposal will be the one that meets the qualification and technical requirements and has the lowest estimated cost.

Competitive proposals submitted by the Selection Participants later than the specified deadlines shall not be accepted and shall not be considered.

By submitting its proposal, the Participant expressly agrees to all the terms and conditions specified in the Company’s requirements.

Each Selection Participant can submit only one competitive proposal.

Validity of commercial proposal shall be at least 60 calendar days.

Competitive proposals may not be amended after the deadline for submission.

The winning Selection Participant shall provide a bank guarantee in the amount of 5% of the total Contract cost before signing the Contract. In case of advance payment, the winning company shall provide a bank guarantee for the advance payment not less than the amount of the advance payment.

Requests for clarification of the selection terms and conditions shall be sent 5 calendar days prior to the deadline for proposal submission.
